Massachusetts Senator Scott P. Brown Responds to Attorney Piandes' Inquiry Regarding Immigration
"Dear Mr. Piandes, Esq.
Thank you for your letter regarding the need for immigration reform. As always, I value the input of my constituents of all issues.
As you know, on April 23, 2010, Governor Jan Brewer signed Arizona's immigration into law, sparking intense outrage by some and support from others. While supporters of the legislation note that is only enforcing what federal immigration law already mandates, those who disapprove counter that the law will foster racial profiling and further violates the Supremacy Clause of the U.S. Constitution, which gives the federal government authority over the states in immigration matters. On July 6, 2010, the U.S. Department of Justice filed a lawsuit against the state of Arizona, asking that the law be declared invalid. On July 28, 2010, the day before the law was scheduled to go into effect, a U.S. District Court judge issued a preliminary injunction preventing the most controversial sections from taking effect, finding these likely to be unconstitutional because they were preempted by federal immigration laws.
Since Arizona enacted this new immigration law, at least 20 other states have either expressed outright support for the bill or are considering enacting similar legislation as it would apply to their states circumstances. Clearly, these actions signal a strong desire by individuals across the United States to have Congress and the Administration work together to find solution to reform our current immigration policies, paying close attention to how our laws relate to those who seek out illegal labor and those who are here illegally. Illegal immigration can be both a risk to U.S. security and also hamper our efforts to revive the economy with jobs for U.S. citizens because of those who choose to exploit cheap, illegal labor.
While members of Congress have introduced various bills related to immigration, the Senate has yet to debate any of this legislation on the floor. Senator Charles Schumer (D-NY) has led efforts to put forward a comprehensive plan that, among other things, establishes a procedure for admitting temporary workers and introduces a path to legislation for undocumented workers already here , as well as strengthening border security and interior law enforcement. After the disasters in Haiti, Senator Kristen Gillibrand (D-NY) introduced the Haitian Emergency Life Protection Act of 2010 (S. 2998), which proposes to amend the Immigration and Nationality Act to include provisions for families to stay together when coming to the United States for refuge. Others have also started discussions regarding the English Language Unity Act (S. 991) introduced by Senator James Inhofe (R - OK) which declares English the national language of the United States.
I understand your concerns over the complex and far-reaching issue. I will carefully review any immigration legislation that comes before the Senate, keeping your thoughts in mind. I have always been a strong proponent of legal immigration, believing that we should immediately streamline the process for those who are seeking citizenship through the legal and proper channels. It is also true that the United Staes has been and must remain a nation of laws. Therefore, we must continue working to secure our borders as this is vital to our national security and the safety of all Americans. I also believe that the government should not adopt policies that encourage illegal immigration. I have opposed proposals that include amnesty of access to tax-payer funded benefits for those who are in this country illegally.
